Achievements and immediate plans to improve legislation were discussed in the Federation Council
During a round table, Deputy Head of the FAS Russia Sergey Puzyrevsky spoke about the measures taken by the service to create a favourable competitive environment and protect entrepreneurship in current economic conditions and congratulated everyone on the 30th anniversary of the antimonopoly authorities in Russia. The event took place at the Federation Council of the Federal Assembly of the Russian Federation.
In the course of the radical modernization of the antimonopoly legislation, four antimonopoly packages were adopted, which allowed FAS Russia to enter the top 10 competition authorities in the world by the end of 2019 in the "Rating of the effectiveness of competition authorities". Besides, the Organization for Economic Cooperation and Development (OECD) has recognized that the Russian Federation meets the requirements for OECD membership in the area of competition.
In 2015, the FAS initiated amendments to Russian legislation, providing for the expansion of the scope of the institution of prevention, the introduction of immunities for small businesses, the introduction of an intradepartmental appeal procedure, the establishment of the obligation to analyze the state of competition when considering all cases for all types of violations.
"As a result, since 2015, the number of initiated cases on violation of antimonopoly legislation has decreased by three times (from 9,000 to 3,000). At the same time, the number of warnings has increased; that is, we are working in a preventive manner. Their feasibility is over 80%. This is a direct consequence of the reform," said Sergei Puzyrevsky.
As anti-crisis measures taken in connection with the new coronavirus infection COVID-19, the FAS ruled out scheduled inspections and reduced the number of unscheduled inspections, except for the request of the prosecutor's office. Compared to the first half of 2019, in the first six months, the total number of inspections for violations of antimonopoly legislation is 15% lower.
According to the speaker, the principle of long-term tariff regulation was spread in the area of tariffs. Also, the opportunities for exceeding the maximum level of tariffs in the constituent entities of the Russian Federation were eliminated, and a principle was introduced that encourages organizations to reduce costs through the implementation of the reference cost method - "Together with the Ministry of Economic Development, a draft law "On state regulation of prices (tariffs)" has been prepared and submitted to the Government. It seems to us that the effective development of tariff regulation is impossible without an appropriate law. Moreover, its adoption is provided for by the National Plan for the Development of Competition for 2018-2020," said Sergei Puzyrevsky. The Deputy Head of the FAS Russia also positively assessed the development of exchange trading in Russia.
During the event, the National Plan for the Development of Competition for 2021-2025 was discussed, and its priority tasks will be the development of a competitive environment in sectors of the economy, reducing the share of organizations with state and municipal participation in competitive markets in sectors of the economy and supporting small and medium-sized businesses.
