Andrey Tsyganov, Deputy Head of the FAS, spoke at the XV International Economic Forum “Russia – Islamic World: KazanForum.”
Currently, the FAS of Russia notes the growth of trade turnover, expansion of investment cooperation and reorientation of Russia's trade and economic relations towards Asian and African countries.
The Deputy Head of the Service noted that both Russian and foreign entrepreneurs must comply with the rules of doing business in the host country, in particular, it refers to fair and honest competition. FAS of Russia, as a body controlling compliance with competition laws, considers this work not only from the point of view of control and supervisory functions, but also as an element of business protection from unscrupulous market participants. Maintaining a favorable business climate is one of the priority tasks of the Service.
The Law on Protection of Competition is extraterritorial in its nature. The FAS of Russia considers applications from citizens and legal entities and initiates cases on violation of antimonopoly legislation, guided by the principle of competitive neutrality. Thus, both Russian and foreign companies may become subject to antimonopoly cases. This also applies to organizations registered in other countries but operating in Russia. In this regard, extraterritoriality is an important element of law enforcement practice of Russian antimonopoly legislation.
Andrey Tsyganov noted that the rules of antimonopoly regulation are in the process of continuous improvement. To this end, the “Fifth Antimonopoly Package” was adopted, which improves antimonopoly legislation in terms of regulation of digital markets. The Service regularly holds public discussions of innovations in law enforcement practice within the framework of Expert and Public Councils. Thus, FAS of Russia strives to find a balance of interests of all market participants.
In 2023, the FAS of Russia initiated 1,482 cases on violation of antimonopoly legislation, reviewed 1,071 cases and issued 1,966 warnings. The Antimonopoly Service also received 992 filings and 156 notifications on economic concentration transactions.
