Russia Increases Fines for Obstructing Anti-Cartel Inspections

The law was signed by the President of Russia.

Previously, the maximum fine for legal entities for obstructing a cartel inspection was 10 thousand rubles ($113), and if it resulted in the impossibility of conducting or completing the inspection — 50 thousand rubles ($567). Such amounts did not deter the unlawful behavior of the inspected companies, and as a result FAS of Russia specialists could not collect the evidence necessary for the investigation. 

The adopted law toughens fines for obstructing inspections for signs of anticompetitive agreements for legal entities with differentiation by revenue. Now the amount of fines will be as follows: 

- for revenue up to 120 million rubles - a fine of 100 thousand rubles ($1,135); 

- from 120 million to 800 million rubles - a fine of 500 thousand rubles ($5,678); 

- from 800 million to 2 billion rubles - 1 million rubles ($11,357); 

- from 2 billion rubles - a fine of 2 million rubles ($22,714). 

The FAS notes that this is a strengthening of sanctions for committing unlawful acts, which will not affect bona fide entrepreneurs and will not increase the administrative burden on them. 

*Federal Law No. 262-FZ of 08.08.2024 comes into force on 18.08.2024.
