The Public Council of the FAS Discussed Antimonopoly Regulation in the Context of New Economic Realities

The discussions included in particular, the practice of application of antitrust law to speculative actions in pricing.

The session was opened by Andrey Sharonov, Chairman of the Public Council of the FAS Russia. The agency's position on the agenda was presented by Andrei Tsyganov, deputy head of the FAS Russia, and the heads of the relevant departments.

During the meeting, Andrey Tsyganov noted that the department immediately responds to violations of antimonopoly law, such as abuse of dominance, the conclusion of anticompetitive agreements or the implementation of anticompetitive actions, including those aimed at unreasonable price increases.

At the same time, the Federal Antimonopoly Service protects the interests of not only citizens, but also small and medium-sized businesses. Many companies in the domestic market apply pricing methods recommended by the Federal Antimonopoly Service of Russia, as well as adjust their trade and marketing policies in accordance with the agency's recommendations.

Also during the meeting, Acting Head of the Legal Department of the FAS Russia Maryana Matyashevskaya presented a report on the departmental prevention program for 2021. The development of a departmental program for the prevention of violations by controlled entities provides for its annual discussion at the Public Council. She drew attention to the areas of control of the FAS, within which the implementation of activities is carried out, as well as to the key results of the implementation of the prevention program.

During the meeting of the Public Council, the issue of separate clarifications regarding the acceptable and unacceptable practices of applying price algorithms in the course of business activities was also discussed. The agency has reviewed the submitted initiatives and will assess the feasibility of their implementation.
