CADE Enters into an Agreement to Investigate a Cartel in Bids for the Acquisition of Orthotics, Prostheses and Special Materials

On 27th of April, The Administrative Council for Economic Defense signed, a Cessation Commitment Term with the company St Jude Medical Brasil in a process that investigates the formation of a cartel in public bids for acquisition of orthotics, prostheses and special materials (OPME), in the segment of implantable cardiac stimulators and accessory items.

The investigation began in November 2015, based on a representation sent to CADE by the Ministry of Justice and Public Security, when an administrative inquiry was initiated to investigate the facts presented.

The procedure resulted in the opening of two distinct processes in the municipality, among them the one that investigates illicit conduct in the segment of implantable cardiac stimulators (implantable cardioverter defibrillator, resynchronizer and pacemaker) and accessory items (electrodes, sets of introducers and catheters). These products are used in the diagnosis and treatment of heart disease.

Under the Cessation Commitment Term signed with CADE, St Jude Medical Brasil must pay R$ 56.4 million as a pecuniary contribution. The company also admitted to participating in the investigated practice and undertook to cease the conduct and to collaborate with the antitrust agency in the elucidation of the facts.

For the application's rapporteur, counselor Luis Braido, the agreement meets both the legal requirements and meets the criteria of convenience and opportunity that justify its approval by CADE's Court.
