CADE Publishes Study on Methodologies to Evaluate Competition Advocacy Actions

The document produced by the Department of Economic Studies (DEE) aims to present standards to evaluate the impact and effectiveness of advocacy activities performed by the authority.

On 10 July, the Administrative Council for Economic Defense (CADE) published a working document regarding methodologies to evaluate competition advocacy actions, produced by the Department of Economic Studies (DEE) of CADE. The document, written by the expert in public policies and government management, Nelson de Almeida Torreão Júnior, proposes some methodology to evaluate the impact and effectiveness of the competition advocacy actions of CADE.

According to the study, competition advocacy "is understood as any activity performed by the antitrust authority aiming to promote a healthy competitive environment, which does not have legal enforcement nature.” Generally, these actions are addressed to government bodies of Brazil's Executive and Legislative branches, to follow regulatory policies and bills to avoid measures that have anticompetitive impact. However, these actions also have the purpose to disseminate the competition culture and the benefits of a free market economy in society.

The document strengthens the relevance of competition advocacy in the Brazilian scenario through documentary research and international case studies, considering its intersections with the Brazilian Economic Freedom Law. Additionally, it provides suggestions for the improvement of assessments on competition advocacy actions performed by CADE.

According to the chief economist of CADE, Guilherme Resende, publishing this document will strengthen the authority's actions. 

"The study will help CADE to soon apply an appropriate methodology to measure the benefits that these activities have produced to society in recent years”, 

stated Mr. Resende.
