Myths of legal monopoly, or a tale of why innovation does not develop in Russia with stubborn protection of intellectual property

The author addresses three myths, on which, as on three whales, the intellectual property protection regime established in post-Soviet Russia is based, aimed at serving the interests of global monopolies to the detriment of the interests of the Russian economy and society, including innovative start-ups. These are myths about legal monopoly, the great incentive and the good foreign investor. As the author shows on the basis of numerous studies and empirical data, the thesis of legal monopoly is nothing more than a rhetorical device to avoid a meaningful discussion about the harm of antimonopoly immunities for intellectual property; intellectual rights do not create incentives for innovative activity in themselves and in the absence of antimonopoly restrictions rather restrain it, while the excessively strict intellectual property protection regime does not help to attract foreign investors.
