Moscow Court Confirmed the Legality of the FAS Fine of $12 Million (906 Million rubles) for Apple

The company must pay it for abuse of dominance.

The Moscow Arbitration Court rejected Apple Inc's claim to appeal against the FAS decision and instruction, as well as the ruling on the imposition of a fine.

It should be reminded that in August 2020 FAS of Russia completed consideration of the antimonopoly case against the company initiated as a result of consideration of the application of "Kaspersky Lab" JSC.

On April 26, 2021 FAS of Russia imposed on Apple Inc. a turnover fine of 906 million rubles for violation of antitrust laws.

The watchdog found that Apple had abused its dominant position in the market of distribution of mobile applications of other developers on the iOS operating system by barriers that led to the provision of competitive advantages to its own products, while launching a similar "parental control" service.

The FAS also found that the provisions of Apple's documentation contained consistent restrictions on third-party developers.

The Service issued a mitigation order to the company, which requires the organization to remove provisions from the documentation that allow apps from other developers to be excluded from the App Store for any reason, even if they meet all the requirements, and to ensure that developers of parental control apps can distribute them in the App Store without losing important features.

The company attempted to appeal the decision and order of the service, as well as the order to impose a fine, but the court of first instance upheld the FAS position.
