The Arbitration Court Supported the Decision of the FAS Russia in the Booking.com Case

On March 3, the Arbitration Court of the Moscow District rejected the company's cassation appeal.

Earlier, the department recognized the company as violating antitrust laws. Booking has abused its dominant position in the market for the provision of information aggregator services for hotels, hotels, hostels and other accommodation facilities.

The company imposed unfavourable contract terms on Russian hotels, hotels and hostels, according to which they were obliged to provide it and observe for their part price parity, availability of rooms and conditions in all sales channels and distribution of their services.

According to Russia’s FAS, such parity conditions lead to the fact that hotels, inns and other accommodation facilities cannot set the price for their hotel services in other sales channels lower than on the Booking website.

The company's actions limited competition in the market and infringed on the interests of accommodation facilities.

The company did not agree with the decision of the FAS Russia and appealed against it in the courts of three instances. Earlier, the Moscow Arbitration Court and the Ninth Arbitration Court of Appeal also upheld the decision and order of the service.
